Terms and Conditions


PLEASE READ CAREFULLLY ALL INFORMATION
Your booking for these holiday packages involves an agreement between you and those providing the travel services. Your reservation constitutes a contract under which you accept all of the terms and conditions in our brochures and the rates or other terms of those travel service suppliers.

RESERVATIONS
Call Avila Tours Inc. to reserve your holiday. If your reservation is accepted 46 days or more prior to departure, a deposit of $350 per person or 10% of the tour cost (whichever is greater) will be required (not including any additional cancellation insurance that you may purchase ). The deposit plus insurance must be forwarded to us immediately. The booking becomes a contract when our written confirmation is dispatched to you.. Final balance must be received by Avila Tours Inc. 45 days prior to departure. If your reservation takes place less than 46 days prior to departure, full payment will be required at the time of booking. For late bookings, very close to the departure date, a supplement may be required, depending on the extra costs involved (e.g. courier, fax, long distance phone calls…). In the event that the payment does not reach us by the due date, Avila Tours Inc. reserves the right to cancel or refuse your reservation and apply cancellation penalties.

CHANGES/CANCELLATIONS (per person)**
Booking Fee: (for land packages under $750.00) $50.00 (with the exception of HOTEL ONLY bookings where a minimum of 3 nights is required for hotel bookings. If less than 3 nights are booked, a $40 service fee will apply).
Amendment Fee: $50.00
Cancellation Fee: 100% of tour cost
After departure No refund of unused portion of services.

Airline bookings: cancellation fees applicable by airline(s) PLUS Avila fees (between $75 - $200 depending on each situation)

INSURANCE PROTECTION - BEFORE AND AFTER DEPARTURE
We strongly recommend travellers to consider purchasing applicable insurance for major reasons (e.g. injury, sickness or the death of themselves or a member of their immediate family or of a single travel companion with whom they are sharing accommodations during the trip), for canceling their trip prior to departure or trip interruption after departure. Adequate insurance coverage for luggage and personal belongings is also encouraged.

HOLIDAY PRICES
Tour costs are quoted in Canadian and/or U.S. dollars, unless otherwise stated, and are based on the costs and exchange rates in effect at the time of contract negotiations with suppliers. They are subject to change without notice. Our prices do not include any items other than those specified and exclude such items as expense of personal nature, airport taxes, tips and gratuities, local municipal taxes.

DOCUMENTATION
Passengers should be in possession of a valid passport and must ensure that they comply with applicable visa requirements. It is the responsibility of each person to obtain the necessary documents at his/her expense. Every effort has been made to describe as accurately as possible the travel services you are purchasing. You must however be aware that each country or region has particular features (e.g. food, water, weather, customs, etc.) which may or may not appeal to you. There may be different living standards, practices and conditions at your destination, compared with what you are used to. By purchasing these travel services, you are presumed to have made all necessary inquiries in this regard.

LIMITATION OF RESPONSIBILITY

Avila Tours Inc. makes arrangements with suppliers who provide your travel services such as airlines, cruise lines, hotels, buses, sightseeing, train, car rental, or other activities included in your tour.

Although we try our best to choose the most reputable suppliers, we cannot be responsible for their acts and omissions. Avila Tours Inc. acts only in an agent's capacity for passengers in all matters relating to goods and services rendered and as such, hold themselves free of responsibility for any delay, loss of property, injury, accident, death, damage, inconvenience, loss of enjoyment, upset, distress, or frustration, whether physical or mental, resulting from any of the following:

Any wrongful or negligent act or omission on the part of any travel suppliers or their personnel or any company or person not under the direct control of Avila Tours Inc.

Although we believe all our hotel information and reports to be accurate, we shall not be liable in any way to you or any third parties should any such information or reports prove to be incorrect or incomplete in any way.

Sickness, theft, labor disputes, machinery breakdown, quarantine, war, government restraints, weather, closed roads or accesses, or any other cause beyond our direct control. Failure on passenger's part to obtain the necessary documentation by the time of travel, in which case Avila Tours Inc. cannot refund any monies paid.

Failure to arrive at the airport on time on the day of departure or to be on time for the various convocations during the trip, for any reason.

Avila Tours Inc. reserves the right to modify the itinerary or the carriers, substitute accommodation whenever necessary or cancel the trip completely. In such an event, it will not be liable for claims, damages or losses beyond the refund of costs saved as a result of the change. In the even of the cancellation of the trip by Avila Tours Inc. , the full refund of monies paid, less insurance will represent the final settlement with the passenger. If a modification in the itinerary results in a saving, a refund would be made, conversely if the modification should entail additional expenses, such expenses would be borne by the passenger. Avila Tours Inc. reserves the right to decline to accept or retain any person as a tour member whose presence may impede the operation of the rights or enjoyment of the passengers. Under such circumstances, unused land services only will be refunded. Avila Tours Inc., suppliers and carriers accept no responsibility for loss of tickets, coupons or any travel documents.

No representative of Avila Tours Inc. or the suppliers is authorized to modify or cancel any of the above unless it is done in writing between Avila Tours Inc. and the client.

While at travel destination, any concerns or complaints about your arrangements (hotels, touring, etc.) must immediately be reported and made through local representative listed on travel vouchers.

Written notice or any claims against Avila Tours Inc. must be received no later than fourteen (14) days after your return from your trip.
